Respect for the privacy of individuals is an important concern of FIFTY-FIVE. We undertake to comply with the provisions of Law No. 78-17 of 6 January 1978, as amended, relating to information technology, files and freedoms, as well as those of Regulation 679/2016 of 27 April 2016 on data protection .

This Privacy Policy is intended to exclusively manage the processing of data collected directly by the following websites (and their sub-domains): www.fifty-five.com, www.fifty-five.fr, www.fifty-five.co.uk, www.fifty-five.hk, www.fifty-five.us.

It also applies to data that FIFTY-FIVE collects on social networks from its European locations.

The processing of personal data on behalf of legal entity clients is the subject of agreements directly concluded with them and is not covered by this Privacy Policy.

What is personal data?

In accordance with Article 4, 1° of Regulation 679/2016 of 27 April 2016 on data protection, personal data is defined as any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

We (FIFTY-FIVE) may collect personal data from you, or receive data from you, via our websites, blogs, forms or FIFTY-FIVE pages on social networks. This data can be: your name, first name, email, telephone, as well as your company's contact details or a free comment area.

You provide this personal data directly to FIFTY-FIVE, for example when you make a contact request via the website form. In other cases, we collect data through the use of cookies to understand how you use our websites. The cookie policy is described in a separate document from this Privacy Policy.

When we collect data, we identify with an asterisk those data that are essential to process your request. These are generally the last name, first name and email address. Therefore, not recording the fields marked with an asterisk will make it impossible for us to reply to you.

What are the purposes of the processing and/or use of your personal data?

We collect data for the following purposes:

Processing based on your consent:

● Responding to your contact requests

● Carry out commercial prospecting operations

● Organizing events

Processing carried out on the basis of the legitimate interest pursued by

FIFTY-FIVE:

● Carry out statistical analysis

Who will receive your personal data?

FIFTY-FIVE collects data for its marketing and customer relationship management services and will only be used for this purpose.

We only share your personal data with the following third parties:

● The host of our websites (the website dedicated to the activity in France is hosted in France)

● Marketing service providers to develop and manage our websites, our contact forms or to carry out our advertising campaigns (e.g. emailing).

We only share your personal data with other third parties if we are obliged to do so by virtue of our legal obligations or if requested by public authorities

(e.g. judicial authorities).

We do not share your data with our partners without your consent.

How long do we keep the data?

In accordance with Article 5, e. of Regulation 2016/679 of 27 April 2016, the personal data collected shall be kept, by FIFTY-FIVE, in a form that allows the identification of the data subjects for no longer than is necessary for the purposes for which they are processed.

The data in the prospecting database (including the sending of newsletters) are kept for a maximum of 3 years from the last contact.

The data in the customer database is kept for 3 years after the end of the contractual relationship.

The data required to comply with a legal obligation is stored in accordance with the provisions in force (in particular, but not exclusively, those provided for in the Commercial Code, the Civil Code and the Consumer Code).

Do we transfer data outside the European Union?

We carry out our processing within the European Union and do not transmit our data to recipients located outside the European Union, except possibly within our offices in these countries in the event that the processing would require it (for example: response to a request for contact by an expert based in China). In any case, this processing will benefit from the guarantees described below (contractual clauses of the European Commission).

However, some of the technical service providers who receive your personal data may be located outside the European Economic Area, such as the United States (Google services). For Google services, data protection measures are in place (through the European Commission's standard contractual clauses) and can be consulted here. 

As a result, your personal data may be processed in countries that are not recognized as providing an adequate level of protection for personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

FIFTY-FIVE requires the same level of protection for your data as is required by any applicable European laws and regulations and ensures that its service providers are either bound by the European Commission's standard clauses or are bound by BCRs (binding corporate rules) within their international group and have been duly authorized by a data protection supervisory authority established within the EU.

What are your rights?

Any individual who is the subject of personal data processing has the right to exercise his or her rights of access, rectification, erasure, opposition, limitation to the processing of his or her data, in accordance with Articles 15 et seq. Of Regulation 2016/679 of 27 April 2016, withdrawal of consent if the processing is based on this basis, as well as a right to define post-mortem directives in accordance with Article 40-1 of the amended Law No. 78-17 of 6 January 1978 relating to information technology, files and freedoms. The individual may also exercise a right to the portability of his or her personal data.

These rights can be exercised directly with FIFTY-FIVE. In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of an identity document bearing your signature and specify the address to which the reply should be sent. 

You also have the right to appeal to your supervisory authority.

California Privacy Notice at Collection

This section supplements our Policy with additional information for California residents about our information collection and use practices as required by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”). In this section, the terms “personal information” and “sensitive personal information” have the meaning set forth in the CCPA.

The following chart provides information about our practices in the 12 months leading up to the effective date of this Policy in relation to the categories of personal information that we collected from California residents generally– including the categories of sensitive personal information (precise location information and health information) – the purposes for which we use the information, and the categories of third parties to whom we disclose the information for business purposes.

Sale and Sharing of Personal Information.

If you consent to do so, we may activate third-party targeted advertising, so that we can provide you with more relevant and tailored ads regarding our services, and use related analytics partners to assist us in analyzing the effectiveness of our online ads (more details on the technicalities is provided here https://www.fifty-five.com/legal/cookies-policy). The disclosure of your personal information to these third parties to assist us in providing these services may be considered a “sale” of personal information under the CCPA, or, the “sharing” of your personal information for purposes of “cross-context behavioral advertising.”

If you would like to opt out of our online disclosure such as through cookie and pixel technology of your personal information for purposes that could be considered “sales” for those third parties' own commercial purposes, or “sharing” for purposes of targeted advertising, please use the "Do Not Sell or Share My Personal Information" link in our website footer and follow the instructions provided. Please note that we do not knowingly sell the personal information of minors under 16 years of age without legally-required affirmative authorisation.

Please note that if you have a legally-recognised browser-based opt out preference signal turned on via your device browser, we recognise such preference in accordance with applicable law.

“Shine the Light” Disclosure. You can exercise your rights under the California “Shine the Light” law – which gives you the right to opt out of the sharing of certain categories of personal information (as defined in the Shine the Light law) with third parties for their own direct marketing purposes – by emailing us at dpo@fifty-five.com
